Feb. 5 (UPI) -- A Detroit casino is not liable for $6 million earmarked for construction projects but lost in gambling, Michigan's Court of Appeals ruled on Wednesday.

Casinos in Detroit will be going on a three-week shutdown starting on Wednesday, Michigan Gov. Gretchen Whitmer announced Sunday. The craps tables and other games at Detroit’s three casinos will go. The Marian Ilitch-owned casino resort near downtown Detroit received approval for its debt restructuring Monday during a Michigan Gaming Control Board special meeting, which took place virtually.

The three-judge panel upheld an earlier ruling in Wayne County Circuit Court, which rejected a case in which 12 investors sued the MGM Grand Detroit casino, saying it could have stopped Gino Accettola from gambling with money given him for construction projects in 2014 in Florida and Michigan.

He was convicted of a different crime of fraud in 2018 and is currently serving a prison sentence of seven to 30 years for financial crimes. It was revealed in his trial that he gambled away the investment at the Detroit casino. The judges ruled that, although the casino extended credit and other hospitality to Accettola and could have initiated a credit check, it is not liable for the investors' losses.

'According to plaintiffs, a background check would have revealed that Accettola had no employment or other source for the millions he used to gamble at defendant's casino,' the 11-page ruling read in part. 'It also would have revealed that he had a criminal history involving identity theft and larceny by conversion, among other crimes, and that he had served significant time in prison.'

The judges ruled that the casino acted in good faith, was unaware of Accettola's lack of gambling competence and did not know the money gambled was obtained for other purposes and thus indicated fraud.

Although Corey Silverstein, the investors' attorney, referred to Accettola in court as 'the worst gambler on the planet,' the judges agreed that the casino provided him 'reasonably equivalent value,' indicating that the casino is not accountable for judging a gambler's skill level before wagers are placed or accepted.

A scam artist used prosthetic face masks and other disguises to pose as an elderly gambler and steal more than $100,000 from people at various Michigan casinos, the FBI said Thursday.

Charges against the suspect, identified as John Christopher Colletti, 55, were contained in a 17-page criminal complaint and unsealed affidavit released by a federal court in Detroit, The Detroit News reported.

The case was unsealed after Colletti was found and arrested in Kansas. He was being held in Michigan without bond.

Beginning in May 2019, Colletti developed a scheme of purchasing people’s identities online and creating false driver's licenses, FBI Special Agent Julia MacBeth said.

Since then, Colletti stole the identities of casino customers who were a part of a VIP program that allows cash advances from kiosks located inside the casinos, The Detroit News reported.

The kiosks are located under camera surveillance, prompting Colletti’s disguise.

The suspect was able to steal $98,840 from patrons of the MGM Grand Detroit, from April to May 2019, while wearing a full prosthetic mask, glasses, surgical masks and hats, MacBeth reportedly detailed in the affidavit.

The suspect was caught on camera wearing a prosthetic mask, blue jacket, dark cap, blue jeans and sunglasses at the MGM Grand on May 23, 2019, where he withdrew $30,000 during 15 different transactions within a 30-minute period.

Investigators reviewed camera footage from the casinos and found that Colletti used counterfeit driver’s licenses each time he withdraw casino, according to the local news outlet.

'Then Colletti would look at a piece of paper, likely containing the victims last four digits of the patron’s Social Security Number and the last four digits of the patron’s telephone number, which were needed to complete the transactions,” MacBeth said in the affidavit.

Colletti was arrested March 12 by the Prairie Band Potawatomi Tribal Police at the Prairie Band Casino and Resort in Mayetta, Kan.
